One thing that has been discussed at length in Constitutional Classrooms across the nation has been the question; “Should Supreme Court Justices Have Lifetime Appointments?” Personally, I have always been very skeptical on the age issues of the Supreme Court, why?

Well as people get older their brains harden in places and they process information at a much slower rate, and their memory becomes weak. I have noticed that the top University Students process information faster than me (I am in the mid-40s), but still they do not have the benefit of years of experience or knowledge base that I do.

I have noticed that older people have lots of wisdom, but process very slowly comparatively. I was reading a book recently, you might enjoy it: “Futurecast” by Robert J. Shapiro (a former Secretary of Commerce) and he noted that society changes very slowly whereas in your life during any 15-year period, you change a whole bunch. 20-year term limit might be a tuff. Of course, they have that lifetime appointment in there for a good reason, but why not 30-years or competency tests after 20, each 5-years.

You know a pilot must undergo a flight physical on a bi-annual flight review, so you know they can handle their physical demands, what about mental demands, that’s what a Supreme Ct. Justice is involved with, dealing with complex issues, whose outcomes affect our entire population and thus

the World, that’s a lot of power, too much, (reason for checks and balances).

We had some pretty smart folks setting this up, they had reviewed history, they did not have the benefit of as much modern history as we do, but quite a bit, that’s why the Constitution has worked so well. Should we be re-visiting this question?
